Section 1.0: Emergency Services

No 911 / E911 Emergency Calling

CLEARVX SOFTWARE DOES NOT SUPPORT EMERGENCY CALLS. You acknowledge that ClearVX is an inbound-only software application and cannot be used to contact emergency services (911, 112, 100, 999, etc.).

The User must provide alternative communication methods for all agents and staff. You agree to indemnify and hold ClearVX harmless from any claims arising from the inability to use the software for emergency services.

Section 2.0: Scope of Service

Software-as-a-Service vs. Telephony

ClearVX is a software interface for managing WebRTC connections. We are not a "Common Carrier" or a "Telecommunications Provider."

You provide the SIP Trunk (Carrier).
You pay the Carrier for all minutes and DIDs.
We are not responsible for Carrier-side outages or billing disputes.

Section 3.0: Security

Responsibility for Toll Fraud

The User is solely responsible for the security of their SIP Trunk credentials and IP whitelisting. ClearVX is not liable for "Toll Fraud" or unauthorized charges incurred on the User's carrier account due to compromised credentials or misconfigured carrier settings.

Section 4.0: Privacy

Call Recording Compliance

If you use the optional Call Recording feature, you are solely responsible for complying with the laws of your jurisdiction and the jurisdiction of the caller.

Important:

Many regions require "Two-Party Consent." You must ensure that an appropriate audible notification is played at the start of every call.

Section 5.0: Acceptable Use

Inbound-Only Enforcement

ClearVX is designed for ethical, inbound-only business operations (e.g., Customer Support). Users shall not attempt to bypass dialplan restrictions for the purpose of outbound telemarketing, "robocalling," or any activity that violates applicable regulatory guidelines.

Section 6.0: Liability

CLEARVX PROVIDES ITS PLATFORM ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARVX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
